Terms of Service

These Terms of Service ("Terms") govern your access to and use of the NewkingsDFS website at newkingsdfs.com and the related software, tools, and subscription services (collectively, the "Service") provided by NewkingsDFS LLC, a New York limited liability company ("NewkingsDFS," "we," "us," or "our"). By creating an account, subscribing, or otherwise using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Description of the Service. NewkingsDFS provides sports data analytics software — including statistical projections, data modeling, lineup optimization, and related research tools. The Service is an information and analytics product only. How you use the data and analytics we provide — including any decision to enter daily fantasy sports ("DFS") contests or engage in any other activity on third-party platforms such as DraftKings and FanDuel — is entirely your own choice and responsibility. NewkingsDFS is not a DFS contest operator, sportsbook, casino, or gambling operator. We do not accept, place, facilitate, or process any wager, entry fee, deposit, or payout, and we hold no contest funds of any kind.
2. Eligibility. You must be at least 18 years old, or the age of majority in your jurisdiction if higher, to use the Service. You are solely responsible for ensuring that your use of DFS platforms and of the Service is lawful in your jurisdiction. DFS legality and regulation vary by state and country, and some jurisdictions restrict or prohibit DFS participation. You represent that you are legally permitted to use the Service and any connected DFS platform where you reside.
3. Accounts. You agree to provide accurate registration information and to keep it current. You are responsible for safeguarding your credentials and for all activity under your account. Notify us promptly of any unauthorized use.
4. Subscriptions, Billing, and Automatic Renewal. The Service is offered on a recurring subscription basis. Current pricing, billing frequency, any introductory or promotional rates, and any separate premium tiers will be disclosed to you at the time of purchase and are subject to change. Subscriptions automatically renew for successive billing periods at the then-current rate until cancelled. By subscribing, you authorize us and our payment processor, Stripe, to charge your payment method on a recurring basis. Payment information is collected and processed by Stripe; we do not store full payment card details. We may change pricing prospectively upon notice; changes will not affect the current paid billing period.
5. Cancellation and Refunds. You may cancel at any time through your account settings or by contacting us at patkingpin@newkingsdfs.com. Cancellation stops future renewals; you will retain access through the end of the current paid period. Except where required by law, subscription fees are non-refundable, and partial-period refunds are not provided.
6. Acceptable Use. You agree not to: (a) resell, sublicense, or redistribute the Service or its outputs except as expressly permitted; (b) scrape, reverse engineer, or attempt to extract source code or underlying models; (c) share account access to circumvent subscription terms; (d) use the Service for any unlawful purpose or in violation of any third-party platform's terms; or (e) interfere with the integrity or performance of the Service.
7. No Guarantee of Results; Assumption of Risk. The Service provides data, projections, optimization, and analysis based on modeling that may be incomplete or inaccurate. NewkingsDFS does not guarantee the accuracy of any data or projection, or any particular outcome, result, profit, return, or winnings, and past performance does not predict future results. Any decision you make using our analytics — including any daily fantasy sports entry on a third-party platform — is your own, and you are solely responsible for those decisions and for any financial losses. You use the Service and make any such decisions entirely at your own risk.
8. Third-Party Platforms; No Affiliation. DraftKings, FanDuel, and any other referenced platforms or marks are the property of their respective owners. NewkingsDFS is an independent service and is not affiliated with, endorsed by, sponsored by, or otherwise associated with DraftKings, FanDuel, or any DFS operator. Your use of those platforms is governed by their own terms, which you are responsible for following. We are not responsible for the acts, omissions, availability, or rules of any third-party platform.
9. Brand Asset License. Subject to these Terms, NewkingsDFS grants you a limited, revocable, non-exclusive, non-transferable license to download the NewkingsDFS emblem made available on the Service solely to use as a personal profile avatar on DFS platforms. All trademark, trade dress, and other rights in the emblem and the NewkingsDFS name remain the exclusive property of NewkingsDFS. This license does not permit any commercial use, modification, or use that implies endorsement, affiliation, or sponsorship by NewkingsDFS, and it may be revoked at any time.
10. Intellectual Property. The Service, including all software, models, projections, text, design, and other content (excluding your own data), is owned by NewkingsDFS and protected by intellectual property laws. We grant you a limited, revocable, non-exclusive license to use the Service for your personal, non-commercial DFS purposes during your active subscription.
11. Disclaimers. THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT DATA OR PROJECTIONS WILL BE ACCURATE.
12. Limitation of Liability. TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEWKINGSDFS AND ITS OWNER, AGENTS, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DFS LOSSES, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO THE SERVICE. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
13. Indemnification. You agree to indemnify and hold harmless NewkingsDFS from any claims, damages, losses, and expenses (including reasonable attorneys' fees) arising out of your use of the Service, your DFS activity, or your violation of these Terms or any third-party rights.
14. Termination. We may suspend or terminate your access at any time, with or without notice, for any violation of these Terms, for conduct we reasonably determine to be abusive, fraudulent, harmful, or otherwise inappropriate — including conduct that harms or threatens other users, our staff, the integrity of the Service, or our reputation — for any conduct described in the Acceptable Use section, or to comply with law. Upon termination, your right to use the Service ceases. Sections that by their nature should survive (including ownership, disclaimers, limitation of liability, and indemnification) will survive.
15. Changes to the Terms. We may modify these Terms from time to time. Material changes will be posted with an updated Effective Date, and your continued use after changes take effect constitutes acceptance.
16. Governing Law and Dispute Resolution. These Terms are governed by the laws of the State of New York, without regard to conflict-of-laws principles.

Privacy Policy

This Privacy Policy explains how NewkingsDFS LLC ("we," "us," or "our") collects, uses, and shares information when you use newkingsdfs.com and the Service.
1. Information We Collect.
- Account information: such as name, email address, and login credentials.
- Payment information: processed by our payment processor, Stripe. We receive limited billing details (such as subscription status and the last four digits of a card) but do not store full payment card numbers.
- Usage and device information: such as pages viewed, features used, IP address, browser type, and similar analytics data.
- Service inputs: settings, preferences, and configurations you create within the Service.
2. How We Use Information. We use information to provide and operate the Service, authenticate users, process subscriptions, respond to support requests, improve and secure the Service, prevent fraud and abuse, and comply with legal obligations.
3. How We Share Information. We do not sell your personal information. We share it only with: (a) service providers who operate the platform on our behalf, including our hosting and database providers (for example, Vercel and Supabase) and our payment processor (Stripe); (b) authorities or other parties when required by law or to protect our rights and users; and (c) a successor entity in connection with a merger, acquisition, or sale of assets. Service providers are permitted to use the information only to perform services for us.
4. Cookies and Analytics. We and our providers may use cookies and similar technologies to keep you logged in, remember preferences, and understand usage. You can control cookies through your browser settings, though some features may not function without them.
5. Data Retention. We retain personal information for as long as your account is active and as needed to provide the Service, and thereafter as required to comply with legal obligations, resolve disputes, and enforce agreements.
6. Data Security. We use reasonable administrative and technical safeguards to protect your information. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.
7. Your Rights. Depending on your jurisdiction, you may have rights to access, correct, delete, or restrict the use of your personal information, or to request a copy of it. To exercise these rights, contact us at patkingpin@newkingsdfs.com. We will respond as required by applicable law.
8. Children's Privacy. The Service is not directed to anyone under 18, and we do not knowingly collect information from anyone under 18. If we learn we have collected such information, we will delete it.
9. Changes to This Policy. We may update this Policy from time to time. Material changes will be posted with an updated Effective Date.

Responsible Play
NewkingsDFS is a sports data analytics product, not a daily fantasy sports operator — we don't run contests or hold funds. That said, many of our users apply our analytics to DFS contests on third-party platforms, which involve real financial risk, so a few words on that. No tool or projection can guarantee winnings or eliminate the risk of losing money. If you choose to play, please play within your means.
- Only enter contests with money you can afford to lose, and set limits for yourself.
- Treat DFS as entertainment, not as a source of income or a way to recover losses.
- The tools and projections we provide are aids to your own judgment, not guarantees of any outcome.
